Residence and tax residency in Slovakia

“Moving your residence” and “being a tax resident” are not the same thing. The first is an administrative procedure; the second is a qualification that depends on substantive criteria and that authorities assess by looking at a person's overall situation.

Understanding this difference is essential, because it is where almost all the errors and approximate information on this subject are concentrated.

Three distinct concepts

  • Residence registration

The step through which an EU citizen registers their stay with the competent Slovak authorities. It is a formal procedure with its own documentary requirements.

  • Correspondence address

The address where you receive mail. Useful and often necessary in practice, but it does not describe where you actually live nor determine your tax position.

  • Tax residency

The qualification that determines where you are taxed. It is assessed on the basis of substantive criteria and applicable rules, including international conventions where two States might both consider you resident.

Access to any tax benefit depends on your personal situation, on the type of pension and on compliance with the applicable requirements.

What is typically looked at

Factual elements come into the assessment of tax residency: where you actually spend your time, where your permanent home is, where your main personal and economic interests are located.

A credible move is a real move. A path built only on documents, without a consistent actual presence, exposes you to the risk of later challenges — exactly what serious advice should help you avoid.

The role of AIRE

AIRE registration is the step through which an Italian citizen living abroad registers with the consular authorities. It is part of the process and we assist you with the procedure.

However, AIRE registration is not in itself proof that tax requirements are met: it is a formal element within a broader picture.

Our approach

  • an honest reconstruction of your situation first, documents afterwards
  • a clear distinction between administrative steps and tax questions
  • legal assistance for legal assessments related to the tax residence change
  • no promises about outcomes that depend on the authorities
